If you are considering filing for divorce, the process will seem scary. There are so many things about it that you don’t understand. If you could find a company that had you fill out a questionnaire and did the rest of the work for you it would be so much easier. There are companies out there that claim to offer such a service, though they may not explain everything, leaving you with questions for how you really finish the process.
Working with an attorney gives you access to something similar yet much more helpful. You have access to someone who can answer the phone when you have a question and let you know how things are progressing. You will be working with someone who is familiar with the process and all the required forms so that you don’t have to be.
Even in the most simple of divorce cases, it can be helpful to have an attorney who can take care of the filing and service of papers. An attorney can also make sure that you have everything you need for the court to approve your divorce once you are ready to request a final judgment.
In San Diego Family Courts it can be months after submitting your judgment paperwork before you receive something back. If you are submitting everything yourself you will likely get a rejection notice with your papers telling you that you forgot something. Figuring out what to fix before re-submitting everything can be stressful. When you work with me I will guide you through the process and take care of any issues that arise.
When I am helping clients prepare for finalizing their uncontested divorce for that last submission I make sure that they have all of the disclosures completed and all of the other forms included that will make it much more likely that the clerks will approve everything the first time. I will also guide you through the disclosure forms so that you don’t have to figure them out alone. Clerks are strict and will reject your paperwork for the smallest problem. Understanding which boxes to check on the forms when doing them yourself can be very difficult because you aren’t familiar with the different terms the court uses.
If you got the process started using an online service you can always bring what you have done to me before everything is done to make sure there are no problems. If you are still in the early stages, I can help you fix any problems that might exist on your divorce petition. If you are getting ready to finalize everything, I can help you get together everything you need to submit for the court. I can also help make sure your Marital Settlement Agreement has all the necessary terms.
Though filing for yourself is appealing because of the money you will save, the amount of stress you go through because you don’t know if you are doing everything right is not worth the savings. Things are stressful enough with you trying to figure out how you will get by living on your own to have to stress about a bunch of forms.
I charge a fixed fee for truly uncontested cases so that as long as you both still agree to everything there won’t be any extra costs before you get everything approved by the court. If you come to me with your uncontested divorce before anyone has filed the courts charge a $435 filing fee that is separate from my fixed fee. If you are considering divorce and want to discuss your options with someone give me a call or clicking the Contact Us button on the side of your screen to send me a message.
